It
was discovered in April of 2004, the Village Assoc. 2001, 2002 and 2003 state
and federal income taxes had not been filed. MOD had taken over Village
property management in 2001.
The
issue was discussed with Will Lewis of MOD on 04/22/04 and he confirmed MOD has
not done any of the Assoc. income tax since they took over in 2001. Will
mentioned Tom Lauzon had been doing the taxes for Village and typically sends
out an engagement letter to the Assoc. Treasurer in September.
Tom
Lauzon was engaged on 04/26/04 to prepare the Village income taxes.
The
issue was discussed with Tom Lauzon Salvador and Babic, Inc. tax accountant on
04/26/04. Tom commented he prepared the 2001 income taxes, however he did not
prepare 2003 and 2003 income taxes. He also mentioned he sent an engagement
letter to MOD, the Village property agent at the time in September of 2002 and
2003 and did not received response; therefore did not prepare the taxes.
Will
Lewis emailed Kurt Ries the MOD/Village accounting package, Quickbooks data
export on 04/30/04. Kurt passed along the accounting data from 03/01/99 - 12/31/03 to Tom Lauzon on
04/30/04.
Tax preparation update was discussed Tom Lauzon
05/14/04, he completed the 2001, 2002 and 2003 Village taxes.
Tom is now using Kurt Ries's postal mailing address for
all tax correspondence, and will be sending an engagement letter in September
along with what information is needed for 2004 taxes.
Tom contacted the State and Feds to check Village's
filing status:

Even though Tom has a record of
preparing the 2001 tax statements, looks like the 1031 was never filed
·
Taxes had not been prepared or filed
for 2002 or 2003
·
Tom had the State and Feds check under
both Villages TIN#
Tom prepared the 2001, 2002 and 2003 tax statements with
the new Village
TIN# and Village owes $750 ($250/yr X 3). State and Feds
will be charging
an interest fee and should be under a $100. The State
and Feds will
probably be charging a penalty of $50 to $60 per year,
however Tom
mentioned if we plead our case to the State and Feds we
will probably not
have to pay the penalty portion.
Kurt Ries signed the Tax statements, on 04/19/04.
Joe Boylan cut check for $750 and mailed taxes on
04/20/04. Because the Tax preparation for a nonprofit is a simple single form,
Joe Boylan is considering doing taxes for all his Assoc. next year.

just spoke with Tom Lozan regarding the filing of the Village taxes. He
stated
that the last time that he filed the taxes for Village was for 2001.
All
of our Village files have been turned over to Joe Boylan and we
therefore
do not have any tax information here.
Tom said that he will be
in
contact
with you early next week regarding the taxes, as Joe will be away
next
week. If you have any further questions
regarding this matter please
