Heads up on the Brita,

 

Brita and/or Pur will NOT EVEN COME CLOSE  to cleaning up the contaminants.

In fact, the only way to affectively do this is to purchase a filtration

system for the faucets that (according to the size avail and the water usage

in your home) could run upwards of a couple hundred to poss. 1,500$. Both

the Listers and ourselves installed one. If interested, call and we will

forward the info to you. My home 434 4051. Andea and Bretts 434 4241. It is

good for around 5-10yrs, depending again on size and usage. Already, we have

gone thru 3 filters as our water was very dirty.

 

Enough of us, I am emailing Geoff Commons and hoping to hear from him soon.

I did ask that we put a time on the response from Larry as we all know how

this can spin out of control on the calendar.

 

Also, myself and all interested, have been invited to Jericho comm center,

Oct 24, for a chance to meet Gay Simington in person. All the key players

that have helped us will be there, i.e., Peter Welsh, Bill Frank, Bernie

Sanders, and of course Gay. Remember, these people were the ones that were

CONSTANTLY calling me back and checking in with the opening question, "what

can we do?". Gay included!!!

 

I am working with Peter Welsh/ Trisha Coats, and Bernie Sanders on a

national level to get a tax credit for those who install water filtration

systems for the very reason as stated above.....expense!!  Because of the

immediate issues with our global finances, Trisha and I last spoke and we

will address this more aggressively once the climate settles somewhat. It is

NOT going to disappear.

Thank you for your comment RE: filtration systems.  I'll ask Wynne to weigh

in, but it is my understanding that the issue with the disinfectant

by-products cannot be corrected with something as simple (or simplistic) as

a brita or pur filter.  In fact, the Kirschbaums are in the process of a

large investment in a specific filter to deal with this.  It is, though,

worth looking into.

What is the timeline for the Department to propose the settlement? I might

have missed it but I did not see a date.

 

Another thing you might suggest to Larry et. al., either as a condition or a

holdover action - perhaps they propose to spring for Brita or Pur filtration

systems for the customers / water users. For $15 - $20 they might

demonstrate that they are working toward solving this problem while the

larger items get sorted out.

Hi All,

 

I wanted to give you all a more coherent/extensive update on the ongoing

Water situation. 

 

Wynne Kirschbaum (Snowdrift Lane) and I had a very productive phone

conversation with the counsel for the Department of Public Service regarding

the ongoing issue and pending petition to the Public Service Board.  It is the

Department's intent to come to an agreement before we are engaged in a

protracted legal proceeding before the Board.  Wynne (who is the authorized

representative of the "community") and I (an informed bystander!) are

very supportive of this initiative.

 

The Department is going to contact Larry and propose a settlement of the

Issue that incorporates many of our concerns.  Briefly, they are:

 

1.  A 30-day refund for the period during which we were under a boil water

order.  Legally, this is a slippery slope, so the only way we can conceive

of actually getting this refund is through a settlement.  Also, even though it

will be a nominal amount of money, it goes a long way to demonstrating Larry's

willingness to work with the community in good faith.

 

2.  The incorporation of the stipulations of the Water System's Temporary

Operating Permit into a Public Service Board order.  The order would simply

reinforce all of the aspects of the permit, but would add some sort of

penalty. Currently, it is our understanding that the only recourse the Water Supply Division (entity that issued the permit) has for reprimanding the Water System for a violation of deadlines or any aspect of the permit, is the revocation of the permit.  This is not an effective check and balance system!

 

3.  The Water System needs to develop a better plan for regularly

Communicating with the community.  We offered several options: regular articles in the Bolton Gazette, postings on the Bolton community website, e-mail distribution lists,

and better and more coherent information in regular mailings.  We particularly

pointed out the relative lack of information regarding the water testing.

The System will inform us that the haloacitic acid level is high, but we don't

get any of the details.

 

4.  We have asked that the Board incorporate our concerns about future

development and the potential demand that may have on the Water System into

any order.  It is clear that Larry is intent on drilling wells and pumping

 that water into the System, resulting in less reliance on surface water, which

will result in less chlorination and ultimately less chlorination byproduct.  Our concern is that he will do this, relieving the problem for now, but as he

increases residential demand on the system, he will simply go back to using

surface water, which will bring us back to where we started.

 

5.  That the Water System convene a community advisory board or a task force

of interested neighbors and community members to work with the System on a

regular basis.  This would not be a regulatory or governing board, but would allow community representatives to be in regular contact with Larry, would allow

him the opportunity to update the community on a regular basis and would

hopefully build a better rapport between us and them.

 

So, this will all be proposed to Larry, and we'll see where he takes it.

Any one of these action items will put us ahead of where we are, but I sincerely

believe that all of them will help him as much as it will help us.

Hello everyone,

 

I was contacted by the state Public Service Board requesting my presence at the pre-hearing for financial reimbursement. It is a public hearing, I was asked to represent our community.

I will also be asking for a tax credit due to the neccess. of water filtration in order to safely consume the water. The water sample test from the meeting, which we exposed a 3-5 x elevation about limit of chlorine byproduct, will be rediscussed there as well further documenting the REQUIREMENT for filtration.

I received your messages today and am following up with Larry and Mike regarding the complaints of high chlorine levels and lack of notification if chlorine levels have been increased.

 

As far as the water reservoir, Tom Brown of our office conducted a sanitary survey inspection of the water system on May 28, 2008. Also present were Matt Guerino of our office and Mike Bernardine, Water System Operator. As I mentioned in my email, I will forward you a copy of Tom’s survey letter when completed.  

 

Tom reported the following to me regarding the reservoir: “During the site inspection that I conducted, as part of my sanitary survey, the tank was observed by both Matt and I to have no measurable amount of sediment in the tank.  Water clarity within the tank was acceptable.  It was reported by the system operator that the debris was removed from the tank, which stirred up some turbidity within the tank, and that their tank cleaning contractor came back (once the turbidity had settled out) to complete the tank cleaning and inspection.  I have updated our records to reflect that the tank cleaning and inspection deficiency has been corrected.”

 

Based on Tom’s observation during the survey, the tank has been cleaned and this deficiency has been corrected.

We want to know what the tank looks like NOW without the debris. Of course the picture tells us that debris was removed. Was it ALL removed, is there sediment still present that is causing more chlorine useage? We need a set of eyes to check out the work. REMEMBER, this is a guy/co who had NO PROBLEM leaving this garbage in our ready to drink water holding tank for ..............however long.

This is the guy/co that did NOT communicate with us. AND, by the way, to date, I have not seen any reminant of "vacuumers" or activity of same at the shed.

 

We insist on viewing the tank bottom now that time has elapsed and sediment must have settled. Also, there needs a rpt generated so that we know in writing, this was done.AGAIN ALL of us are complaining about a strong smell of chlorine the last couple of days

Good morning,

 

Just to let all the residents know, today Mike Bernadine and others (?) were up at the water shed doing extra inspections with divers IN the water. That being said, remember, we were told at the meeting last week, that when divers, equipments, etc go in the water, EXTRA CHLORINE goes in too!!

 

For those of you who drink the water, remember, when chlorine levels are higher, the TOXIC BYPRODUCTS ARE HIGHER TOO.  We pointed out other times when these were 5 times higher than EPA standard.

 

I am going to contact Larry and Mike to ask them to remember to post notice and send information as to when work will be done to OUR  water so that we can plan ahead.

WE DID IT! As of 9am today the 18th of April, the state and offices of Bob

Leahey, mandate that the tank be cleaned of debris, water itself cleaned,

the cracks and holes fixed on the concrete foundation. Also, each week,

someone from state will be around to inspect the work!

 

I spoke directly to one member of the EPA. A website is avail. to anyone

who is concerned at any time. www.epa.gov/safewater which lists the

federal limits on MCL's (min. contaminant levels) Personnally, I still

have a concern, as does the EPA that any old/new pipes laying around up in

the woods may be leaching minerals/metals into the water. For this reason,

I am planning on following their guidlines and taking a sample of water

into the Dept of Health in Burlington for COMPLETE testing. That means

metals, inorganic materials, minerals, bacteria etc.

 

PLEASE BE AWARE: THE TESTING DONE AS OF TODAY IS FOR 3 STRAINS OF E COLI

ONLY. REMEMBER, THERE WAS METALS AND MAGNESIUM FOUND IN THE WATER. I ALSO

SPOKE TO A MEMBER OF THE CDC (Center for Disease Control). THIS CAN BE A

HEALTH ISSUE INVOLVING EVERYTHING FROM KIDNEYS TO BRAIN, TO CANCER, TO

BONE, MENTAL DEVELOP ETC. MAKE YOUR OWN CHOICE AS TO WHETHER OR NOT TO

DRINK THE WATER. WE WILL CONTINUE TO DRINK BOTTLED UNTIL THE METALS AND

MINERALS ARE GONE OR SEVERLY REDUCED.

Update..

We just heard from the office of Peter Welsh. They called The Agency for

Natural Resources. They were told that there is still testing ongoing

today April 16th. Yet when we called Catamount 8 and 9 am, both times the

recording states that "the boil water is lifted as of today."

 

Warren spoke to Gary Schultz directly from the Agency as above. He, Gary,

said they only test for 3 bacteria related to e.coli. Warren informed him

of the lack of tarp/covering over the tank since the shed collapse and

that perhaps in addition to the large debris still in the water, might

there be a dead animal or two? Gary's response, ........silence!

 

After speaking to Ellen Parrdoering, Certification and Compliance Mgr

yesterday, I raised the question as to why no one from state has been up

here to eye what was going on and ask questions. After all this is water

that all the residents up here use. Her response, "Well,....we were

planning on coming up sometime soon."

 

Gary Schultz from the Agency of Natural Res. also said he had not been up

here. Question. If no one has been up here from a state/gov agency...HOW

IS THE WATER GETTING TO THEM FOR TESTING AND WHO IS RETRIEVING IT?

 

This just in. Matt Guerino from state just called me and NOW after calling

these agencies. etc he and a crew are coming up today with cameras to take

pictures and test our water. When I asked him if he could tell me what was

at the bottom of the tank, he had no answer. Also, when I asked him how

deep the tank was, he had no answer. Not to worry, I helped him do the

math with square footage and gallon capacity!!!

Warren and I have been on the phone the last hour contacting Peter Welsh

(spoke to his staff) Gay Simington, Pat Laheay, Bernie Sanders whose staff

is calling Larry themselvs.  

Issue to date, water supposed to be clear for off boil BUT lots of ???

debris still in the water. A diver called me the other day, Dave Hathaway.

He offered to come up with ROV and asses the bottom, give an estimate, all

for free. To date, he has not recvd any calls back. Larry tells state the

"sometime" in May he would remove the debris.  

Question, can he exactly identify any of the contents at the bottom

without taking a direct look? Is there a dead animal or two at the bottom?

But we are going to be told that the boil water notice is off and water

clean knowing the ???? is at the bottom.  

I will keep everyone in the loop as I can but need/appreciate any and all

communication between residents. We want to get a directory together but

have not done that quite yet.

I spoke with a gentleman this morning by the name of Dave. He owns a co of

proff divers and asked if we wanted him to come up and clean the tank? I

refered him to Mike B. and on his return call to me, it appears he and his

team will be up to clean/vacuum the bottom of the water of all debris,

mold, etc. He tells me they will not have to disrupt srv for anyone, will

complete the job in one trip/one day, and we will have clean water. 

I do not know the date sched. but I will keep everyone up to date on that

and any future info. 

Could I ask people to send me their contact info? It is becoming very

apparent that a "directory" would really be handy. I would love to start a

monthly get togther for anyone and everyone up here so that we can all

talk, keep in touch etc. I do intend to keep in touch with Susan Hudson

and Susan Martin from Vt Dept of Pub Services on a monthly basis. They

were very upset (to be understated) that no one from Cata. or Reds.

notified them of this collapse. It was only thru Joel Baird, at the Free

Press, that they had any wind of trouble. I keep in contact with Joel and

at the request of him and all 3 TV stations, that I and ANde Lister did

interviews with, they want to do follow up stories. 

Stay tuned. I hope to get petitions back ASAP (this weekend?) so that they

can be in the mail early Mon. to state. They want to start working on

getting us a refund ASAP

To date, I received only a few sig from the Village Condos. Dave Parrot

got 4-5 but that is all. I need to get this in to the state by Wed am

early. If not, we stand a chance of being ignored now that the shed is

built.

 

I am following with state, Matt Guerino and Susan Martin, to make sure

this is played fairly. Warren took a walk down yesterday, and there is a

ton of debris in the water. There is also a question of a crack(s) in the

cement that need to be addressed. When he asked Matt last week late, he

was told "well, we'll deal with that later". Not while I'm around. I am

mailing/calling him today and letting him know we are physically aware, by

wittness of the debris and cracks/holes. I want anwers as to how this will

be fixed. Also, when is the co of divers coming to vacuum the bottom and

clean the water. I spoke to these people last week when they called me and

said it was a go after speaking to Mike B. WHen???

below in regards to the potable water issue on the mountain and advise me

In addition also recall our discussions at the Village Annual Owners

meetings about the Bolton Valley Fire District: The corrective action to

this many faceted problem, potable water, excessive sewer costs, reliable

maintenance, fixing dilapidated infrastructure, stormwater run off issues,

responsible development on the mnt, has been put in motion by the creation

of the Bolton Valley Fire District, this is an existing public entity.

The last three years at the Village Annual owners meeting we made a

desperate plea to our members to volunteer for the Bolton Valley Fire

District and take possession of the Water/Sewer district and form a public

municipality, with state grants, and fed assistance.

None of our member step up to the task. Same plea was made to the other

Assoc. and private owners on the mountain, very little interest in taking

control and correcting the situation. BV Fire District is dyeing if not

dead already.

I would encourage you to get involved and to spread the word there is a

viable solution out there. Owners will need to take control of there own

destine or continue to leave in the hands of the Redstone/Catamount Water

and Sewer,  private sector, who primary objective is development of the

resort.

Hi everyone,

 

First, I am Wynne Kirschbaum, one of the many residents of Bolton Valley.

We live at the top of Snowdrift Lane, next to the collapsed water shed.

I obtained your mail address in hope of getting some assistance in a

matter related to the water issue at hand. Myself and a few neighbors, put

together a petition to request refund from Catamount/state water systems

for the time we were without complete service due to the watershed

collapse.

I would refer you to the article posted in the Burlington Free Press, 4/9,

about the matter. We are only short the few signatures needed to send this

to the state offices, as I have been advised by Susan Martin, Dept of

Public Health. She and I spoke today as stated in the letter I attached

"April 9". People are angry, esp after having to put up with the

inconvenience for over 3 wks, poor communication, and finally the bill!

When asked about a refund, we were told simply, "this is a break even

organization and we have NO intention of any refund or discount."

Unfortunate. for Catamount, the state does. But we need signatures and

quickly.

I have volunteered to be the rep for a near future court hearing by the

state board and will go happily to represent our community. Many I spoke

with while obtaining signatures, are simply fed up.

Any information sent to us has been delayed, misinformed and required

myself and Andrea Lister (Thacher Rd) to make several phone calls to the

state level demanding to know why the delays, update timeline, etc. It was

only AFTER these mails and calls, did the flyers get distributed to all

the residents.

So, we are asking if you will first list the condo owners of your

assoc.and sign for them as pres./rep of the condo group. When complete,

please fax them back to me @ 434 4239 please, ASAP. Time is critical.

It was only after we made noise with Burlington Free Press and they

published today's article (page 2b), did all 3 local channels call me and

do individual interviews.

Quite simply, I need help. If you have any questions, I will be home tomm

working from my office here. I gave up work today to get paperwork,  TV

interviews, more petition signatures etc. I can be reached 434 4051.
